Terms of Service

2.1 You must be at least 18 years old to use our services.

2.2 You are responsible for maintaining the confidentiality of your account credentials.

2.3 You agree to provide accurate and complete information.

2.4 You are responsible for all activities under your account.

2.5 Notify us immediately at security@frontlinevisibility.com of any unauthorized use.

3.1 Plans: Our pricing plans are detailed on our website. All plans include a 7-day free trial (no credit card required).

3.2 Payment: Fees are billed in advance monthly or annually, depending on your selection. Payments are processed securely by Stripe. All fees are non-refundable except as required by law.

3.3 Taxes: Fees do not include taxes. You are responsible for all applicable taxes (VAT, sales tax, etc.). For EU customers, VAT will be added where applicable based on your location.

3.4 Plan Changes: You can upgrade or downgrade at any time. Changes take effect immediately. If you downgrade, you will lose access to certain features.

3.5 Cancellation: You can cancel your subscription at any time via your dashboard. Access continues until the end of your billing period. No partial refunds.

4.1 We offer a 7-day free trial for new customers.

4.2 During the trial, you get full access to all features of your selected plan.

4.3 No credit card is required to start the trial.

4.4 You will not be charged unless you upgrade before the trial ends.

4.5 We reserve the right to limit trial access to prevent abuse.

5.1 License: We grant you a non-exclusive, non-transferable, revocable license to use the platform during your subscription.

5.2 Acceptable Use: You agree NOT to:

• Reverse engineer, decompile, or copy the platform
• Use the platform for illegal purposes
• Attempt to circumvent our security or rate limits
• Use the platform to harm, threaten, or harass others
• Scrape data from our platform for commercial purposes
• Interfere with the platform's operation

5.3 Rate Limits: We may impose reasonable rate limits to ensure fair usage across all customers.

6.1 Our platform queries third-party AI platforms to collect publicly available information. We do not control these platforms and are not responsible for their availability, accuracy, or changes.

6.2 AI platforms may update their models, APIs, or terms, which could affect our service. We will make reasonable efforts to adapt.

6.3 The AI Visibility Scores are estimates based on our methodology. They are provided "as is" without guarantee of accuracy.

6.4 You are responsible for how you use the insights and recommendations provided by our platform.

7.1 Our IP: Frontline Visibility, the AI Visibility Score™ methodology, our logo, and platform are the exclusive property of Frontline Technologies B.V. You may not use our trademarks without written permission.

7.2 Your IP: You retain all rights to your User Content (prompts, preferences). You grant us a license to use this content solely to provide our services (e.g., to run your prompts on AI platforms).

7.3 Feedback: Any suggestions or feedback you provide may be used by us without compensation or obligation.

8.1 Both parties agree to keep each other's Confidential Information confidential.

8.2 Confidential Information does not include information that is publicly available, already known, or independently developed.

8.3 This obligation survives termination of this agreement.

9.1 Our data practices are governed by our Privacy Policy.

9.2 We act as a data processor for your User Content, and you are the data controller.

9.3 For customers in the EU/EEA, we comply with GDPR. We offer a Data Processing Agreement (DPA) upon request.

9.4 We process data only to provide our services and as instructed by you.

10.1 We aim for 99.9% uptime, excluding scheduled maintenance.

10.2 We will notify you of scheduled maintenance in advance.

10.3 We are not responsible for downtime caused by third-party AI platforms, internet issues, or force majeure.

10.4 Enterprise plans include an SLA with service credits for downtime.

11.1 To the maximum extent permitted by Dutch law, our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11.2 We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or data
• Business interruption
• Decisions you make based on our platform's insights

11.3 This limitation does not apply in cases of gross negligence, willful misconduct, or death/personal injury.

13.1 By you: You may cancel your subscription at any time.

13.2 By us: We may suspend or terminate your access if you violate these terms or fail to pay fees.

13.3 Effect: Upon termination, your access ends. We may delete your data after 30 days unless retention is required by law.

14.1 These terms are governed by the laws of the Netherlands.

14.2 Any disputes shall be resolved exclusively by the courts of Amsterdam.

14.3 For EU customers, nothing limits your right to file complaints with local consumer protection authorities.

16.1 Entire Agreement: These terms constitute the entire agreement between you and Frontline Technologies.

16.2 Severability: If any provision is found invalid, the remainder remains in effect.

16.3 Waiver: Our failure to enforce a provision does not waive our right to do so later.

16.4 Assignment: You may not assign these terms without our written consent. We may assign them in connection with a merger or acquisition.
